Welcome to OpenResourceCartography ("we," "us," or "our"). You are subject to these Terms & Conditions ("Terms") when you use our yacht charter services or visit our website at openresourcecartography.sbs (the "Service") run by OpenResourceCartography.
You consent to adhere to these Terms upon reserving a yacht or utilizing our Service. Access to the Service is prohibited if you do not agree with any part of these terms.
2. Service Overview
OpenResourceCartography offers a selection of high-quality yacht charter services, including:
- Yacht charters for daily hire
- Evening sailings
- Business events
- Personalized celebrations
- Charters spanning several days
Availability of our services is dependent on multiple factors and weather conditions. We maintain the right to alter or cancel services without prior notice.
3. Booking and Reservations
3.1 Booking Process
Requirements for booking a yacht include:
- Being a minimum of 18 years old
- Submitting accurate and comprehensive details
- Issuing the necessary prepayment as outlined in your reservation confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A booking is only confirmed after we receive the payment and provide you with a written acknowledgment. We retain the prerogative to deny service to any individual according to our discretion.
3.3 Availability
Yacht reservations are subject to the availability of the boat and appropriate weather conditions. We will strive to meet your requested dates and times when possible.
4. Payment Terms
4.1 Pricing
All stated prices are in € and include applicable taxes unless stated otherwise. Prices are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: A prepayment of 50% of the full charter price at the time of booking
- Final payment: Due 48 hours prior to the start of the charter
- Extra fees (if any): Payable after the charter concludes
4.3 Payment Methods
Accepted forms of payment include major credit cards, bank transfers, and certified checks. We use secure and encrypted systems for payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If canceled more than 72 hours before departure: Full refund, less processing fees
- For cancellations made 24-72 hours before departure: 50% refund
- For cancellations made less than 24 hours before departure: No refund
5.2 Weather Cancellations
In case our captain determines weather conditions as unsafe, we will suggest:
- Rescheduling your reservation to another available date without extra charges
- Granting a complete refund if rescheduling is unfeasible
5.3 Mechanical Issues
Should there be mechanical difficulties with the yacht allotted, we will try to provide an adequate replacement. We will issue a full refund if there is no alternative yacht available.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger is expected to:
- Adhere to instructions from the crew
- Use safety gear as necessary
- Inform us of any health conditions that could impact safety
- Stay within the designated areas on the yacht
6.2 Prohibited Items
Items forbidden on board include:
- Glassware
- Illegal drugs
- Weapons of any kind
- Possessing more than a moderate amount of non-alcoholic beverages
- Pets (unless given prior authorization)
6.3 Conduct
Guest conduct should be courteous at all times. If a guest's behavior endangers safety or disturbs other passengers, we reserve the right to end the charter prematurely without a refund.
7. Liability and Insurance
7.1 Our Liability
Our liability is confined to the cost you have paid for the charter. We are not responsible for:
- Injuries caused by passenger negligence
- Loss or damage to personal belongings
- Secondary or punitive damages
- Delays due to weather or situations beyond our control
7.2 Insurance Coverage
We carry comprehensive marine insurance for our vessels and operations. Passengers should secure their travel and personal insurance policies.
7.3 Assumption of Risk
By partaking in our charter services, you acknowledge the inherent risks associated with marine activities and accept responsibility for your safety and security.
8. Modifications and Itinerary Changes
We retain the right to adjust itineraries, routes, or schedules based on weather, safety, or operationals needs. Attempts will be made to provide similar alternate experiences whenever possible.
9. Force Majeure
We are not liable for setbacks, annulments, or changes due to forces beyond our control, including:
- Extreme weather events
- Natural disasters
- Governmental restrictions
- Port closures
- Technical malfunctions
10. Privacy and Data Protection
We manage your personal details according to our Privacy Policy. Through the utilization of our services, you give consent to our data collection and usage as depicted in our Privacy Policy.
11. Intellectual Property
Our website's content, including text, visuals, logos, and images, is safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without our express consent.
12. Governing Law
The applicable laws in Germany will govern these Terms. Any dispute shall be settled in the courts within the jurisdiction of Hamburg, Germany.
